Agency Agreements are legal documents used to transfer statutory responsibilities between bodies. We can enter into Agency Agreements to take on functions from other bodies under section 90 of the Energy Act. They require Ministerial approval and are signed by our Chair (since 1 April 2014).
Legal arrangements made on the creation of ONR in 2014 means that the agreements should be interpreted as applying to us and the successor body in all cases where it states HSE and a former government department.
- Agreement with Department of Agriculture Environment and Rural Affairs Northern Ireland (DAERA)
Relates to the ADR carriage of class 7 goods by road functions, that ONR agrees to perform on behalf of DAERA in accordance with section 28(1) of the Northern Ireland Act 1998 and section 90(1) of the Energy Act 2013. Effective from: 7 November 2023 - Agreement with Maritime and Coastguard Agency
Relates to the International Maritime Goods Code including the obligations related to the transport by sea of dangerous goods that ONR agrees to perform on behalf of the Secretary of State under section 90(1) of the Energy Act 2013. 3 November 2023 - Agreement with Civil Aviation Authority
Relates to the technical instructions for the safe transport of dangerous goods by air that ONR agrees to perform in accordance with the Authorisation under paragraph 15 of Schedule 1 to the Civil Aviation Act 1982 and agreement under section section 90(1) of the Energy Act 2013. Effective from:10 October 2023 - Agreement with HSE regarding the delegation of inspection functions
The Agreement enables ONR to act as the enforcement authority on HSE’s behalf in relation to obligations under The Radiation (Emergency Preparedness and Public Information) Regulations 2019 (REPPIR19) associated with transit premises used for the civil transport of radioactive material. Effective from:28 July 2020 - Agreement with the Department for Business Energy and Industrial Strategy (BEIS)
Relates to the granting of permits and permission for the disposal of any fissile materials produced at certain nuclear installations that ONR agrees to perform on behalf of the Secretary of State in accordance with section 90(1) of the Energy Act 2013. Effective from:14 May 2018 - Agreements with Police Constabularies across England, Scotland and Wales
Relates to specific functions which the Chief Officer of each respective force will be entitled to perform on behalf of, but not to the exclusion of ONR with regards to the Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009, in relation to the civil carriage of class 7 (radioactive) goods. Effective from:3 May 2017 - Agreement to clarify the definition of authorised defence sites within the Health and Safety (Enforcing Authority) Regulations 1998
Relates to the transfer of enforcement responsibility from HSE to ONR on authorised defence sites in accordance with the Health and Safety (Enforcing Authority) Regulations 1998. Effective from:14 April 2015 - Agreement with Department for Business, Innovation and Skills (now BEIS)
Relates to the Import of Goods (Control) Order 1954 that ONR agrees to perform on behalf of the Secretary of State in accordance with section 90(1) of the Energy Act 2013. Effective from:1 April 2014 - Agreement for Employers' Liability (Compulsory Insurance) Act 1969 ("ELCI")
Relates to the administration and enforcement of the Employers' Liability Insurance Act in relation to GB nuclear sites, new nuclear build sites and authorised defence sites in accordance with section 90(1) of the Energy Act 2013. Effective from:1 April 2014 - Agreement with Department for Energy and Climate Change (now BEIS)
Relates to the duties of directing the Civil Nuclear Police Authority and obtaining independent advice on the effectiveness of the Civil Nuclear Constabulary that the ONR agrees to perform on behalf of the Secretary of State in accordance with section 90(1) of the Energy Act 2013. Effective from:1 April 2014
