Information requested

I am writing to you under the Freedom of Information Act 2000 and/or the Environmental Information Regulations 2004 to request the following information in relation to the above.

  1. Can you provide details of planning applications where the ONR advises against a proposed planning development, in accordance with the ONR's Land Use Planning Policy, which has subsequently been discounted / overturned as a consequence of a decision being made either by a Local Authority, the Planning Inspectorate and other formal review.
  2. Please provide details whereby the ONR advises against a proposed planning development, in accordance with the ONR's Land Use Planning Policy, to erect a temporary building structure which will be occupied by the general public and up to 4 permanent/temporary personnel with a proposed life-span of up to 5 years being located with an defined Detailed Emergency Planning Zone (DEPZ) throughout the United Kingdom. 
  3. Please provide details whereby the ONR advises against a proposed planning development, in accordance with the ONR's Land Use Planning Policy, to erect a permanent building structure which will be occupied by the general public and up to 4 permanent/temporary personnel being located with a defined Detailed Emergency Planning Zone (DEPZ) throughout the United Kingdom.

We confirm that under Section 1 of the FOIA, we do not hold the information described in Part 1 of your request. Please note that local authorities and the Planning Inspectorate are not required to inform us of their decisions which overturn any advice we may give regarding a proposed planning development located in a non-COMAH land use planning consultation zone.

Nevertheless, to be helpful as possible and in accordance with our duty to provide advice and assistance under Section 16 of the FOIA, we advise that the information you are seeking is already available in the public domain and can be obtained via searching the websites of or contacting the relevant local authorities or the Planning Inspectorate directly.

We also confirm under Section 1 of the FOIA that we do not hold the information in Parts 2 and 3 of your request. This is because we do not maintain records which distinguish between temporary and permanent buildings, with a level of occupancy above a specific threshold, as specified in your request.

However, under our duty to provide assistance under Section 16 of the FOIA, please find attached an Excel spreadsheet extracted from our database which sets out our most recent records relating to active land use planning applications located near nuclear licensed sites. You may find the details contained such as the planning application number/subject, the application type, and the relevant planning authority helpful in conducting your search directly from the relevant local authorities’ or Planning Inspectorate’s website.
