What affect do each of these properties have on the "control" of the Capenhurst Nuclear Licensed site? Copies of all supporting documents.
- What is the transaction classification and safety significance of each of the 3 listed properties?
- Supply all documentation used to justify the classification of each property transaction.
- Supply a copy of each document supporting ONR approval, date and written legal authority approval.
- Copies of all requests made by the licensee for each property transaction and:

I can confirm that under s.1 of the FOIA, we do not hold this information. Please see below for our response.
The purpose of Licence Condition (LC) 3 – Control of Property Transactions, is to ensure that the licensee, which for the Capenhurst Nuclear Licensed Site, is Urenco UK Ltd. (UUK), remains in control of the whole of the nuclear licensed site, and the activities performed on it, at all times. This includes having rights of access to all parts of the licensed site. Any transaction which transfers property rights outside the licensee organisation has the potential to affect the licensee’s control.
Clause (1) of the version of LC3 attached to nuclear site licences issued to licensees for non-defence related sites states:
“The licensee shall make and implement adequate arrangements to control all property transactions affecting the site or any part of the site to ensure that the licensee remains in overall control of the site.”
LC3 applies to activities being undertaken within the boundary of the nuclear licensed site, which are within the control of the licensee. It does not apply outside of the boundary of the nuclear licensed site.
As such, we do not hold any information pertaining to the questions posed about the “Capenhurst Nuclear Licensed Site Perimeter Properties: The Laurels, Bailiff Cottage and The Kestrels”.
